Today’s subject is a 1790 Mecklenburg County Land Deed between Andrew Dry and Martin Dry. ¹


Transcription:

This indenture made the 22nd day of October in the year of Our Lord 1790 between Andrew Dry of the County of Mecklenburg  Rowan and state of North Carolina of the one part and Martin Dry of the County of Mecklenburg and State aforesaid of the other part witnesseth that for and in consideration of the sum of ten pounds of good and lawful money of said State to me in hand paid by the said Martin Dry to the said Andrew Dry in hand paid the receipt whereof is hereby fully acknowledged to him, the said Andrew Dry hath given granted bargained and sold and by these presents doth give grant bargain and sell unto the said Martin Dry his heirs and assigns a certain piece or parcel of land lying and being in the County and State aforesaid containing one hundred fifty acres lying on the east side of Dutch Buffalo Creek on both sides of the Long Run Beginning at a post oak near Charles Drys old line running thence So 26 degrees West 6 poles to a small Gum in said Run, thence with or near said line South 70 degrees West 17 poles to a Red Oak thence S 14 poles crossing the Woolfs___Branch to a stake, thence N 17 poles Crossing said branch to a B. O. grub, thence the same course N 60 poles to a stake, thence W 6 poles crossing said Long Run to a stake, thence to the Beginning. By a State Grant dated December 2nd and in the IX Year of the Independence and in the year of our Lord 1787 together with all woods mines minerals Hereditaments and appurtenances the said land belonging to have and to hold the aforesaid 150 acres of land with all rights privileges and improvements to the same in any wise belonging to him the said Martin Dry his heirs and assigns forever and the said Andrew Dry for himself and his heirs and assigns doth hereby covenant and agree to and with the said Martin Dry that he the said Martin Dry his heirs and assigns shall and may forever hereafter peaceably and quietly have hold occupy possess and enjoy the aforesaid granted lands and premises without the debt of notification of any wise whatsoever and free and clear from all manner of incumbrancers whatsoever and the said Andrew Dry doth oblige himself and his heirs to warrant and defend the aforesaid granted lands and premises to him the said Martin Dry his heirs and assigns forever against the claims of all persons whatsoever. It's Family Time: The Two Marriages of Dorinda Adair

Dorinda Adair was the daughter of Zadock Adair and Sarah Kelly. I am not an “Adair” surname researcher but my limited research shows she had 8 siblings; 3 sisters and 5 brothers.

The purpose of this articles is to document the  two marriages of Dorinda Adair. Her marriage to Epps Rivers Brown (2nd marriage ) is well documented both in Census and in Land Deeds.

In Lauderdale County, Mississippi Deed Book “D” pages 17 & 18, we have a “Deed of Gift” – Zadock Adair to his Daughter Dorinda Brown, LDS FHL Film # 899134.

Zadock ADAIR, Kemp Co, MS "natural love and affection...unto my daughter Dorinda BROWN, wife of ER BROWN, for $1: negro woman, Jane a slave age 23, also her 2 children, Mariah age 3 and Dempsey age 16 months... Signed Zadock ADAIR. Witness: James Ray, Clerk.

By this Land Deed we know that Dorinda Adair was married to Epps Rivers Brown before 2 March 1844. Dorinda and Epps Rivers’ first born child was a daughter, Sarah O. Brown born  19 April 1843. This birth suggest a possible 1842 Marriage year for Dorinda and Epps Rivers Brown. 

Epps and Dorinda eventually moved from Lauderdale County, Mississippi to Union County, Arkansas. When his dad, John H. Brown died in 1855 his Mother Sarah Rivers Brown moved in with Epps and Dorinda in Union County, Arkansas.

All of this is well documented and easy to find. What is not well documented and easy to find is the first (1st) marriage that occurred on 17 December 1836 in Lauderdale County, Mississippi.

Mr. John R LEATH, Merchant of Daleville to Miss Dorinda ADAIR.

It is not known if Dorinda and Mr. John Leath were divorced or if something suddenly happened to Mr. Leath and he passed away. Regardless sometime in 1842, Dorinda married Epps Rivers Brown and became the mother of a child in April 1843 through this union.

Dorinda Adair Brown died in Union County, Arkansas sometime after the 1880 Census was enumerated. The burial place of Epps Rivers Brown, His Mother Sarah Rivers Brown and wife Dorinda Adair Brown is not known but they all passed away in Union County, Arkansas.

Dorinda Adair was the wife of my 1st Cousin 5 times removed, Epps Rivers Brown. .

Eliza ‘Mollie’ Rivers was born on 13 Jun 1823 in SC. Her parents are unknown.

About 1837, Eliza Rivers and Thomas J. Graves were married; most likely in Chesterfield, SC. The parents of Thomas J. Graves are unknown. Mary Graves enumerated in the Chesterfield County, SC 1850 census is most likely related.  

Thomas J. Graves passed away 15 October 1862 from pneumonia while serving in the Confederate Army at Winchester, Virginia.

Mollie Rivers Graves died on 29 Oct 1898 at the age of 75 and was buried in the Ferguson H. Smith Cemetery in Chesterfield County, South Carolina.

Note:  The cemetery is inside that circle of trees. Cemetery is in bad condition. Only Ferguson Smith's CSA marker and Ann Powell Smith his wife's stone are not broken. All the rest are broken from years of being in a cow pasture.

The Deed above states that Eve Dry is the Daughter of George Dry, Sr and his wife Catherine.
I, George Dry, Senior of Lincoln County, State of Kentucky, in consideration of the natural love + affection which I have + bare unto my beloved daughter Eve Dry in the County of Cabarrus + State of North Carolina
and
that the Lands goods + Chattels which Catherine Dry my wife had in Pofsefsion in the State of N. Carolina at her death

The Deed shows that George Dry, Sr. lived in Lincoln County, Kentucky and  was alive and well on the 13th day of November 1804 when he signed this deed giving his land in Cabarrus County, NC to his Daughter Eve Dry a Deed of Gift.

Yet, there is much conflicting information about these two in on-line trees.

For instance in this tree we can see that George died 9 years before he signed the above deed.



A Kentucky Tax list shows that George Dry, Sr. was alive and well in 1800.



The above tree also shows that Eve was born in 1774 when her mother was 54 years old.

Another tree show that Eve was born in 1757, seventeen years earlier than the above tree.



And lastly, there are trees that has no daughters born to Catherine Bechtel and George Dry, Sr..



These inconsistencies show that research on this family has been very lax and fragmented. It’s very obvious that George Dry, Sr. passed away sometime after 13 November 1804. His exact date of death is still unknown. Research on Eve Dry is also problematic; there are no known reliable source citations for her birth, marriage or death.  

My research is incomplete and at the present time I am not exactly sure how George Dry, Sr. is related.

I, J. D. Wallace, being of sound mind memory and understanding and being in expectation of immediate death do make, ordain, publish and declare this as and for my last will and testament.
1. I give and bequeath to my children, share and share alike, all my personal property.
2. I give, devise and bequeath unto my beloved wife Polly Jane (illegible) Wallace all my real estate for the term of her natural life or widowhood, and at her death or remarriage the same to be divided among my children who share and share alike.
3. I hereby appoint W. E. Courtney to act as guardian for my child that is now underage.
4. I hereby nominate, constitute and appoint L. L. Parker as executor of this my last will and testament, hereby revoking any former wills or instruments of a testamentary character by me made.

John Dock Wallace was born 12 October 1854, a son of Andrew Jackson Wallace and Mary Ann Graves. He married Phallie Jane Plyler, daughter of Isom Plyler and Mary Funderburk in 1891. To this union were born six, maybe seven children.

John Dock Wallace was injured during a town melee/scuffle in Pageland, SC on 12 March 1915. He died in a Charlotte hospital on 19 March 1915.

It’s Family Time~Nettie Gertrude Brock

Nettie Gertrude Brock was born on 5 Sep 1890, the first born child of Pleasant Elmore Brock and his wife Nancy Jane Davis.

She never married; spending her lifetime at home with her parents helping and caring as needed.  Her father Pleasant Elmore passed away in October 1926 leaving her Mother, Nancy, a widow. Her Mother, Nancy, passed away in May 1954.

Nettie Gertrude Brock died 27 November 1962 at the age of 72. She was buried with the family in the Zoar United Methodist Church Cemetery.
  
Nettie Gertrude Brock is my 1st Cousin twice removed.

Identifying the Parents of Charles Doerr/Dorr/Dry

There are one hundred and sixty-six trees on-line at Ancestry for Charles Dry, born abt 1730—35 in Pennsylvania and died before 16 Oct 1797. in Cabarrus County, North Carolina.

It’s hard to believe that 165 people can come to so many different conclusions as to the parentage of Charles Dry.




I did a tally of these trees and the results are:

I have looked at a lot of these trees and as of yet I haven’t found a single document or reference, in any of these trees, that would prove that Charles Dry who passed away in Cabarrus County about 1797 is the son of any of these couples.

When Charles died he left a Will but that WILL was destroyed in a Cabarrus County Courthouse House fire in 1876. The only proof remaining are the Cabarrus County Pleas and Quarters Minutes April 17, 1797-April 17, 1805. His actual death death is unknown yet most of these trees shows a specific death date of 16 October 1797. 

We also find in the P&Q Minutes for 20 October, 1800 an entry that reads:

• Charles Dry, dec’d. Settlement of estate by Owen Dry, extr. Balance in hands of extr. £ 98.6.0 Divided among 6 children, for each £ 16.7.8.

So we know that Charles + Christina Dry had 6 surviving children. No where are these 6 children named with the loss of the Last Will. Five of the six have been identified; they are:

1. Owen Ulrich Dry
2. Johann Martin Dry
3. Phillip Wiley Dry
4. Andrew Dry
5. Anna Christina Dry

A few researchers say the sixth child was Jacob Dry born 1764, migrated to Allen County, Kentucky where he died in 1854. I have no proof to validate this claim.

Charles Dry migrated from Montgomery County, Pennsylvania between 1776 and 1777.  The surname is recorded in the German name DOERR in Pennsylvania records while all the North Carolina records, with one exception, are recorded in the anglicized surname DRY. 

Mecklenburg Land Deed, Book 7 pages 297-300 dated 26 July 1777 is the first recorded deed for Charles Dry to be found within North Carolina records.

Treasure Chest Thursday~Marriage Bond: Peter Dry and Elizabeth Teter

Peter Dry, son of Johann Martin Dry and Catherine Keppel married Hetty Elizabeth A. Teter on 10 Jul 1809 in Cabarrus County, North Carolina.

Peter Dry and Hetty Elizabeth A. Teter had the following children:
    i.    Margaret Ann Dry, born abt 1813; married Simon E. Speight, 5 Sep 1846, Cabarrus County, North Carolina.
     ii.    John Martin Dry, born 22 May 1820; married Mary Jane McCullums, 11 Sep 1856, Cabarrus, North Carolina; died 2 Oct 1899, Concord, Cabarrus, North Carolina.
     iii.    Marian Carline Dry was born on 7 Jan 1824 in Cabarrus County, North Carolina. She died before 1850. Marian is not mentioned in her father's Last Will dated 23 Feb 1850.
     iv.    Mary A. M. Dry was born about 1827.
     v.    Elizabeth Catherine Dry was born about 1829.

Peter Dry passed away bef 17 Dec. 1853, the date his WILL was probated. Only 3 children were mentioned in the Will and these 3 are also listed in the 1850 Census. Elizabeth was found living with her son, John in 1860 but died sometime before 1870.

Peter Dry is my 3rd Great Grand Uncle.

John was 67 years old when he passed away leaving his wife Nancy J. and 9 children two of which were under the age of twenty-one.

Nancy was widowed at age 54; sadly she passed away at age 56 on 1 October 1887. Her surviving children are listed in the above Petition.

The wife of John H. Perkins, Nancy Jane Davis Perkins, is my 1st Cousin 4 times removed.

It’s Family Time~Catharine Dry and John Laton, Sr. Family

While selecting a family member to write about I realized that somehow I had not fully researched this family. However, I decided to stick with the family in hopes that it might reach a cousin who may have more information. 

Catharine Dry was born in 1791 a daughter of Johann Martin Dry and Catherine Keppel.

On 10 June 1824, at the age of 33, Catherine married John Laton, Sr. in Montgomery County, North Carolina.

John Laton, Sr.  and Catherine had the following children:

    i.    Martin Laton was born about 1826.
    ii.    Franklin Alexander Laton, born 13 Aug 1828, Montgomery County, North Carolina; married Martha Ann Solomon, abt 1847; died 11 May 1906, Albemarle, Stanly, North Carolina. 
    iii.    Lydia G. Laton, born abt 1830; married George W. Rummage, abt 1857; died 1869.
    iv.    Catharina Laton was born about 1833. She died on 11 Mar 1894 at the age of 61. Find A Grave Memorial# 102681634.
    v.    James Laton was born about 1838.

Catherine Dry Laton is my 3rd Great Grand Aunt.

Do You Know the Parents of This James H. Purvis

James H. Purvis was born 4 March 1846 in Smith County, Mississippi.

In 1862, he enlisted for the Civil War with Company “D”, Stubbs Battalion Mississippi Cavalry. In 1876, James H. Purvis married a young lady named Louisa Schrimpsher. In the 1900 Census they report having been married 24 years with 5 children of which 4 are living.

On 10 April 1920, James H. applied for a Pension from the State of Texas for his service during the Civil War. His pension was approved on 9 September 1920 and he was assigned Pension #36880. You can view his pension here, on Ancestry, if you have a paid subscription.

Today's posting is a Land Deed between sisters; Nannie (Brown) Glass and her Husband A. P. Glass of Limestone, Texas to Mollie and Lizzie Brown of Union County, Arkansas.

The three Brown sisters are daughters of Epps Rivers Brown and Dorinda Adair. Their father, Epps Rivers Brown, had passed away back in 1882 and their mother has passed away since then.

Elizabeth Jane Sellers is the daughter of  James Arnold “Buck” Sellers and Nancy Jane “Jennie” Johnson.

Elizabeth Jane married Almer Badin Huneycutt about 1919. Almer Badin was the son of Eli Hampton Huneycutt and Hester Ann Smith.

Elizabeth Jane and Almer Badin Huneycutt had 2 children:

• Dwight Jackson, b. 25 Jul 1920
• Alma Derwood, b. 17 Feb. 1922

Elizabeth Jane Sellers Huneycutt is my 1st Cousin twice removed.

Today’s subject is a a 1892 Land Deed between Lafayette Brown, et al to Mollie & Lizzie Brown. ¹
Back in September 2012 and again in July 2013 I did articles on the children of Epps Rivers Brown and his wife Dorinda Adair in an attempt to reconstruct the family based on available data. Those posting can be viewed here.

Knowing that FamilySearch had made a commitment to digitize all their film and make it available on line; I decided to take a look at Union County, Arkansas Land Deeds. It was gratifying to find that the Deed Indexes for Union County both Grantor and Grantee had been digitized. The actual Land Deed have not yet been digitized..

My next step was to look up the Register of Deeds for Union County and send them an E-mail requesting these two deeds and the cost for such service. In two days I had the deeds I requested in hand as a PDF’s by E-mail. Much quicker then when I first started research in 1976 when letters took forever.

This deed, posted here, is one of the two deeds that I received earlier this week from the Union County Arkansas Circuit Clerk.

Epps Rivers Brown and Dorinda Adair had 9 or 10 children based on the 1850-1880 Census. All their children are listed in the above Land Deed with two exceptions:

• Martha J. Brown, b. 1849; listed in 1850, 1860 and 1870 Census. No record beyond 1870.
• Lucy M. “Lou” Brown, b. 1854; listed in 1860, 1870 and 1880 Census. No record beyond 1880.
• The Children above are:
• L. Brown – Lafayette Brown
• N. B. Brown – Napoleon Bonaparte Brown
• W. Brown – Weymon Epps Brown
• D. J. Goodwin – Dora G./J. Brown Goodwin
• Sallie Ward – Sarah O. “Sallie” Brown Ward
• Mollie Brown – Mollie Brown (Mollie is not listed in any census so she may be Martha)
• Lizzie Brown – Lizzie Brown listed in 1860, 1870 and 1880 Census

In both cases, these girls may have married and I just haven’t located the proper documents. As stated above Martha and Mollie may be the same individual.

Further in the case of Mollie & Lizzie, I can find no record of either female after the date of this Land Deed and  one other 1892 Land Deed.

All parties named above in the Land Deed are my 2nd Cousins 4 times removed.

Chesterfield County SC~Estate Folder #199 – Col. Alfred M. Lowery

Each week, on Sunday, I will select an Estate Folders from the Estate files of Chesterfield County and discuss its contents. No known estates exist for the period before the Civil War. They were destroyed with the burning of the Courthouse. There are a few “Equity Records” in the State Archives. Do not overlook this valuable resource if you are looking for ancestors in Chesterfield County, South Carolina.

Col. Alfred M. Lowery died in June 1877. I could find no service record for Col. Lowery indicating that the Colonel title was an Honorary title bestowed upon him based on his status in the community.
Col. Lowery was a prominent figure in the community and served the community as the local land  surveyor.  He was married to Henrietta Jackson, daughter of Henry A. Jackson and Mary Blakeney.

Col. Lowery and  Henrietta had three children:

• Emily Lowery
• John H. Lowery
• Mary Temperance Lowery

There is a Land Deed located in the Chesterfield County Register of Deeds office (DB 10:44-46  that states that Henrietta Lowery, Emily Huntley and Mary T. Davis  are the sole surviving heirs-at-law of Alfred M. Lowry…



John H. Lowry, b. 1837 had passed away on 12 Feb 1888 just months before this 1889 Land Deed was executed.

At the death of Col. Alfred M. Lowery, his widow, Henrietta was granted Letters of Administration on the Estate. Before she could fully administered the Estate Henrietta passed away on 18 August 1890 leaving her two daughters sole survivors.  

Emily Huntley and Mary T. Davis then petitioned the Court for Letters of Administration de bonis non which were granted.

Mary Temperance Jackson married Maj. Alfred W. Davis. Maj. Alfred W. Davis is my 1st Cousin 4 times removed. It’s quite possible that Mary Temperance Jackson is also a 3rd Cousin 4 times removed.

It’s Family Time~David Richard Davis and Mary Cornelia McNair Family

David Richard Davis was born 4 August 1825, a son of William Davis and Julia Thurman. About 1858, at age 33, he married Mary Cornelia McNair, the daughter of Alexander McNair and Catherine McMillan. Mary Cornelia was their first born daughter arriving in February 1835.

David Richard Davis and Mary Cornelia McNair had a large family of 10 siblings; 7 daughters and 3 sons.  Several of their children died young; their children are:

        i.    Margaret J. Davis was born in 1859 and died before 1870 at the age of 11.
         ii.    Eugenia Cordelia Davis, born Sep 1862; married Henry Perkins Davis, 25 Dec 1879;  died 21 Jun 1898.
         iii.    Julia C. Davis was born in  about 1865.
         iv.    Mary Elizabeth Davis, born 1867; married William A. Sellers, 1889; died in  1937.
         v.    John C. Davis was born in 1869; died before 1900.
         vi.    Flora V. "Mitt" Davis was born on 4 Sep 1870; died 8 September 1939.
         vii.    William McNair "Mack" Davis, born 18 Mar 1872; married Mary E. Meehan, 14 Aug 1912;  died 21 Jul 1916.
         viii.    Ida Isabelle Davis, born 8 Apr 1874; married Lewis Maxie Jones, 1902; died 5 Oct 1935, Lake Wales, Polk, Florida,
          ix.  Alfred Thomas Davis was born in 1877; in 1930 census living in Charleston, SC; no further information found.

David Richard passed away in January 1892 followed by his loving wife, Mary, in December 1900. They are buried in the Sowell Cemetery, Chesterfield County, South Carolina.

Heirs at Law of Mary Leach and Flora Sellers

Recently, Chesterfield County has provided a web-based interface for all of their county Land Deeds. Land Deeds in this county before the Civil War were mostly destroyed by fire.  All extant Land Deeds on line are post Civil War with a few dated pre civil war that were brought back to the courthouse and re-register with the local Registrar.

Earlier this week I was browsing Chesterfield County Deed Book 9, pages 37 and 38; Mary McNair and others to Calvin McNair.

This deed caught my attention because of it’s reference to the heirs of Flora Sellers and Calvin McNair married into my Davis line.

The Sellers line is one of my primary direct lines and I wasn't aware of a Flora Sellers that passed away after 1880.

So who is this  Flora Sellers?

A Look at Individuals named:

• Mary Davis is Mary Cornelia McNair Davis wife of David Richard Davis. The McGugan's are children of Angus & Margaret (???LNU) McGugan
• The 3 McGugan named are siblings and the children of Angus M.  McGugan and his wife Margaret (Last name unknown).
• Catherine Martin is Catherine McNair daughter of Alexander McNair and Catherine McMillian. Calvin B., Mary Cornelia and Catherine are siblings.
• Mary McNair Sarah McNair and Mary E. Smith  have not been fully identified but Mary and Sarah McNair may be the daughters of Neil McNair and his wife Mary Crawford.

While researching these families and trying to piece together information on the families I ran across the probate record of Mary Leach (Probate Folder #288), Chesterfield County.

Ironically, some of the same names mentioned in the above land deed (power of attorney) are also mentioned as heirs at law of Mary Leach.

The first family mentioned on this list is the Family of Alexander McMillan and his Wife Mary F. Miller.

The document states:

1. Alexander McMillan is dead. Children are

1. 1. Heirs of Mary Welsh. Mary was married to Francis M. Welsh and  left 3 children Annie John and Pearl.
2. Ellen Blakeney, Ellen married Peter M. Blakeney
3. Dr. Millers wife, this would be Henrietta C. McMillan wife of Robert Peele Miller.
4. Pate Children = Sam Evans wife & Alex Pate. Alexander pate and his sister Sarah Ellen Pate. Sarah Ellen married Samuel Isham Evans. The Pate children mother was Louisa J. McMillan.

The next family is that of Alexander McNair who is also listed as dead. Alexander McNair married Catherine McMillan. Catherine is belied to be the sister of the above Alexander McNair. 

2. Alexander McNair – dead (wife know to be Catherine McMillan)

• C. B. McNair – Calvin B. McNair, son of Alexander McNair
• Katie Martin – as stated earlier, Catherine Martin is Catherine McNair daughter of Alexander McNair
• Mary C. Davis heirs – Daughter of Alex, married David Richard Davis
• Joplin heirs – unknown (??)
• Ida Kor (illegible)

I haven’t sorted out the remaining heirs and how they are related. At the present time based on the research that I have completed thus far I believe that Mary Leach was a McMillan before her marriage to Mr. Leach. All the heirs at law are women with the exception of Alexander McMillan.  Alexander McNair wife is known to be Catherine McMillan sister of Alexander McMillan. I believe Mary Leach is also their sister.
